Dear Tarik:

There is some intersting stuff in:

“The Idea of a Public Basis of Justification for Contract” (1995), 33 Osgoode Hall Journal 273

Cheers,

Dear Colleagues

I was wondering if anyone had come across any work on the philosophical/theoretical foundations of the force majeure/frustration doctrine in contract law. If you have, I would be very grateful if you can send me some references off- or on- list.  To put the question in context: the discussion would be helpful to research I am undertaking on the scope of excuses to the performance of non-contractual promissory obligations.

Kind regards

Tariq
